IRC Services, Inc., doing business as The Termite Guy (“The Termite Guy,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains how we collect, use, retain, disclose, and protect Personal Information when you:

  • visit or interact with 877termite.com or another website that links to this Privacy Policy;
  • request an estimate, inspection, treatment, repair, fumigation, pest-control service, or other service;
  • communicate with us by telephone, text message, email, web form, social media, or in person;
  • make a payment or enter into a transaction with us;
  • interact with our advertisements, customer-service systems, or service providers; or
  • otherwise interact with The Termite Guy as a customer, prospective customer, property owner, tenant, real estate professional, business representative, vendor, or other individual.

This Privacy Policy applies to Personal Information collected online and offline. It does not apply to information governed by a separate privacy notice, including any workforce or job-applicant notice that we may provide.

For purposes of this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household. It includes “personal information,” “personal data,” and similar terms under applicable privacy laws.

1. Notice at Collection

This section describes the categories of Personal Information that we collect or may collect, the purposes for which we use it, the categories of parties to whom we disclose it, and our general retention practices.

The categories listed below also describe the Personal Information we may have collected during the preceding 12 months.

A. Identifiers and contact information

Examples: Name, postal address, service address, billing address, email address, telephone number, customer or account number, online identifiers, Internet Protocol address, and identifiers assigned by our systems or service providers.

Sources: You; members of your household or authorized representatives; real estate agents, property managers, escrow companies, landlords, tenants, contractors, referral partners, public records, service providers, and website technologies.

Purposes:

  • respond to inquiries and requests;
  • provide estimates and schedule inspections or services;
  • create and maintain customer and service records;
  • communicate about appointments, inspections, reports, treatments, repairs, warranties, payments, and customer support;
  • authenticate requests and protect accounts and systems;
  • send marketing communications where permitted;
  • measure website and advertising performance;
  • comply with legal, licensing, insurance, tax, and regulatory requirements; and
  • establish, exercise, or defend legal claims.

Disclosures: We may disclose this information to service providers, contractors, professional advisers, payment processors, communications providers, website and technology providers, analytics and advertising partners, insurers, regulators, law-enforcement authorities, transaction counterparties, and other parties described in this Privacy Policy.

Sale or sharing: We do not sell this information in exchange for monetary payment. Online identifiers and related contact or device information may be disclosed through advertising or analytics technologies in a manner that may constitute “selling” or “sharing” under California law. See Sections 7 and 11.

Retention: Generally for the duration of our relationship and thereafter as reasonably necessary for warranty, legal, tax, accounting, licensing, insurance, fraud-prevention, dispute-resolution, and recordkeeping purposes. Noncustomer inquiries are generally retained for up to 24 months after the last substantive interaction unless a longer period is required for a legitimate business or legal purpose.

B. Customer, property, and service information

Examples: Property address; property type; ownership, tenancy, or property-management status; requested services; appointment details; access instructions; pest or termite concerns; inspection findings; measurements; diagrams; reports; photographs or videos of a property; treatment and repair details; fumigation preparation information; warranty information; correspondence; and information relating to an escrow, sale, refinance, landlord-tenant matter, or commercial property.

Sources: You; another person acting for you; property owners, tenants, occupants, real estate professionals, property managers, escrow or title representatives, contractors, inspectors, public property records, and our employees or service providers.

Purposes:

  • evaluate, schedule, quote, perform, document, and support requested services;
  • prepare inspection reports, estimates, contracts, invoices, completion notices, warranties, and legally required records;
  • coordinate with authorized real estate, escrow, property-management, lending, insurance, or contracting representatives;
  • maintain service history and respond to warranty or follow-up requests;
  • protect people, property, technicians, and equipment;
  • improve service quality and train personnel;
  • comply with pest-control, pesticide, building, contracting, environmental, health and safety, insurance, and other legal obligations; and
  • investigate and resolve complaints, disputes, incidents, or claims.

Disclosures: Service providers and subcontractors involved in providing the requested service; authorized real estate, escrow, property-management, lending, insurance, or contracting representatives; government agencies and regulators; insurers; professional advisers; and other parties as directed or authorized by you.

Sale or sharing: We do not sell or share this category for cross-context behavioral advertising.

Retention: Generally for the life of the customer relationship, applicable warranty periods, and up to 10 years thereafter, or longer where required by licensing, pesticide-use, construction, tax, insurance, litigation-hold, or other legal requirements.

C. Commercial and transaction information

Examples: Services requested, considered, quoted, scheduled, purchased, completed, canceled, or warranted; estimates; contracts; invoices; payment status; discounts; transaction dates; service history; and customer-service records.

Sources: You, our personnel, payment processors, scheduling and customer-management systems, authorized representatives, and service providers.

Purposes:

  • process and administer transactions;
  • provide and support services;
  • manage invoices, payments, refunds, collections, and warranties;
  • maintain accounting, tax, and business records;
  • analyze business and service performance;
  • prevent fraud and misuse; and
  • comply with legal obligations.

Disclosures: Payment processors, financial institutions, accounting providers, customer-management and scheduling providers, insurers, auditors, professional advisers, collection providers, government authorities, and authorized transaction participants.

Sale or sharing: We do not sell or share this category for cross-context behavioral advertising.

Retention: Transaction, tax, and accounting records are generally retained for at least seven years. Service and warranty records may be retained for longer periods where reasonably necessary.

D. Payment and financial information

Examples: Payment method, billing information, transaction amount, payment status, limited payment-card details, financing information, and transaction identifiers.

Payment-card information may be collected directly by a payment processor rather than stored by The Termite Guy. We generally do not intend to retain full payment-card numbers or security codes.

Sources: You, payment processors, financial institutions, and financing providers.

Purposes:

  • process payments, deposits, refunds, and financing;
  • verify and document transactions;
  • prevent fraud and unauthorized transactions;
  • maintain tax and accounting records; and
  • comply with legal and contractual obligations.

Disclosures: Payment processors, banks, financing providers, fraud-prevention vendors, accounting providers, auditors, professional advisers, and government authorities.

Sale or sharing: We do not sell or share payment or financial information for cross-context behavioral advertising.

Retention: Full payment credentials are retained by payment processors according to their policies. We generally retain transaction records and limited payment information for at least seven years or as otherwise legally required.

E. Internet, device, and website-activity information

Examples: Internet Protocol address; browser type; operating system; device type; device identifiers; approximate location derived from an IP address; referring and exit pages; pages viewed; links selected; date and time of access; session information; form interactions; advertisement interactions; cookie identifiers; and information concerning how you use the website.

Sources: Your browser or device and cookies, pixels, tags, software development tools, server logs, analytics providers, advertising providers, hosting providers, security providers, and similar technologies.

Purposes:

  • operate, secure, troubleshoot, and improve the website;
  • remember preferences;
  • prevent fraud, abuse, and security incidents;
  • understand website traffic and use;
  • measure the effectiveness of advertisements and marketing campaigns;
  • attribute inquiries or transactions to advertising sources;
  • deliver or measure advertising where permitted; and
  • comply with legal obligations.

Disclosures: Website-hosting providers, content-delivery networks, security vendors, analytics providers, advertising platforms, marketing providers, call-attribution providers, and other technology vendors.

Sale or sharing: Some disclosures to advertising and analytics partners may constitute “selling” or “sharing” under California law, even when no money is exchanged. You may opt out as described in Sections 7 and 11.

Retention: Security and ordinary server logs are generally retained for up to 24 months. Cookie and advertising identifiers are retained according to the relevant cookie duration, our configured vendor settings, or until you clear cookies or change your choices. We seek to configure nonessential analytics and advertising data with retention periods no longer than reasonably necessary for the stated purpose.

F. Communications and sensory information

Examples: Emails, text messages, web-form submissions, customer-service communications, voicemail messages, photographs, videos, and, where permitted and after appropriate notice, telephone-call recordings.

Sources: You, authorized representatives, our personnel, communications providers, call-management providers, and service providers.

Purposes:

  • respond to inquiries;
  • schedule and provide services;
  • document requests, instructions, consent, and customer support;
  • monitor service quality and train personnel;
  • protect legal rights and resolve disputes;
  • prevent fraud or misuse; and
  • comply with legal obligations.

Disclosures: Communications and customer-management providers, service providers, professional advisers, insurers, regulators, law enforcement, and authorized representatives.

Sale or sharing: We do not sell or share the contents of communications or call recordings for cross-context behavioral advertising.

Retention: Routine communications are generally retained for the duration of the relationship and for up to seven years thereafter when connected to a transaction or service. Call recordings, if used, are generally retained for a shorter period unless needed for training, quality assurance, an active dispute, or legal compliance.

G. Professional and business information

Examples: Employer, job title, business contact details, real estate license or professional role, company affiliation, and the nature of a business or referral relationship.

Sources: You, your employer or organization, business directories, public sources, referral partners, and professional networks.

Purposes:

  • communicate and transact with business representatives;
  • coordinate inspections, services, escrow matters, reports, and repairs;
  • administer referral and professional relationships;
  • verify authority and professional status; and
  • maintain business records.

Disclosures: Service providers, authorized transaction participants, professional advisers, regulators, and parties involved in the relevant business relationship.

Sale or sharing: We do not sell or share this category for cross-context behavioral advertising, except that online identifiers associated with website activity may be handled as described under Internet, device, and website-activity information.

Retention: Generally for the duration of the business relationship and up to seven years thereafter, subject to legal and operational needs.

H. Inferences

Examples: Inferences regarding likely service needs, customer preferences, advertising effectiveness, or likelihood of responding to a communication.

Sources: Information described in this Privacy Policy and analytics or customer-management tools.

Purposes:

  • tailor communications;
  • improve customer service;
  • evaluate marketing performance;
  • identify services that may be relevant; and
  • plan business operations.

Disclosures: Customer-management, analytics, and marketing service providers.

Sale or sharing: Inferences associated with advertising identifiers may be shared for cross-context behavioral advertising where such technologies are enabled. You may opt out as described below.

Retention: For only as long as reasonably necessary for the relevant analytical or business purpose, generally not longer than the underlying information from which the inference was created.

I. Sensitive Personal Information

Depending on the transaction, we or our service providers may process limited Sensitive Personal Information, such as payment-account information, account credentials, precise access information you voluntarily provide, or the contents of communications sent to us.

We do not seek to collect government identification numbers, health information, biometric identifiers, genetic information, racial or ethnic origin, religious beliefs, sexual orientation, or similar sensitive information through the website. Please do not submit such information unless it is reasonably necessary for a specific service or we expressly request it.

We use and disclose Sensitive Personal Information only as reasonably necessary and proportionate to:

  • provide services requested by the consumer;
  • process payments;
  • maintain security and integrity;
  • prevent fraud or unlawful activity;
  • protect physical safety;
  • perform short-term transient uses;
  • maintain or improve the quality and safety of our services; and
  • comply with law.

We do not sell Sensitive Personal Information. We do not use or disclose Sensitive Personal Information for the purpose of inferring characteristics about a consumer.

Sensitive Personal Information is retained only for as long as reasonably necessary for the purpose for which it was collected and any applicable legal requirement.

2. Information We Receive From Other Sources

We may receive Personal Information from:

  • property owners, tenants, occupants, family members, or authorized representatives;
  • real estate agents, brokers, property managers, escrow companies, title companies, lenders, insurers, contractors, and other transaction participants;
  • referral partners;
  • payment processors and financing providers;
  • website, analytics, advertising, communications, call-attribution, scheduling, and customer-management providers;
  • public property, licensing, government, and business records;
  • social-media platforms when you interact with our pages or advertisements; and
  • parties involved in a merger, acquisition, financing, reorganization, or similar corporate transaction.

When another person provides information about you, we expect that person to have authority to do so. Please provide Personal Information about another individual only when you are authorized to provide it.

3. How We Use Personal Information

In addition to the purposes stated above, we may use Personal Information to:

  • provide, maintain, and improve our services;
  • evaluate properties and prepare estimates, inspection reports, contracts, and work records;
  • schedule and perform inspections, treatments, fumigations, pest-control work, construction, roofing, repairs, and related services;
  • communicate with customers, prospective customers, and authorized representatives;
  • administer payments, warranties, complaints, and customer-service matters;
  • operate, personalize, secure, and analyze the website;
  • understand the source and effectiveness of inquiries and advertisements;
  • send service-related and marketing communications;
  • maintain internal records and conduct audits;
  • train personnel and monitor quality;
  • detect, investigate, and prevent fraud, security incidents, and unlawful activity;
  • enforce agreements and protect our rights, property, personnel, customers, and others;
  • comply with subpoenas, court orders, licensing requirements, government requests, and applicable laws;
  • evaluate or complete a business transaction; and
  • carry out another purpose disclosed to you at the time of collection or with your consent.

We do not collect, use, retain, or disclose Personal Information in a manner that is incompatible with the disclosed purpose unless we provide additional notice and obtain consent when required by law.

4. When We Disclose Personal Information

We may disclose Personal Information to the following categories of recipients.

Service providers and contractors

We use companies that perform services for us, such as:

  • website hosting and development;
  • cloud storage and information technology;
  • cybersecurity and fraud prevention;
  • customer-relationship management;
  • scheduling and dispatch;
  • telephone, call-tracking, email, and text messaging;
  • payment processing and financing;
  • accounting, billing, and collections;
  • analytics, advertising, and marketing;
  • document preparation and electronic signatures;
  • customer surveys and review management;
  • data storage, backup, and destruction; and
  • inspection, fumigation, treatment, construction, repair, or other operational support.

Where required, we enter into contracts restricting service providers’ and contractors’ use, retention, and disclosure of Personal Information.

Authorized participants in a service or transaction

At your direction or as reasonably necessary, we may disclose information to property owners, buyers, sellers, tenants, real estate professionals, property managers, escrow or title companies, lenders, insurers, contractors, inspectors, and other authorized transaction participants.

Professional advisers

We may disclose information to attorneys, accountants, auditors, consultants, insurers, financial advisers, and other professional advisers.

Government, regulatory, and legal recipients

We may disclose information when we reasonably believe disclosure is required or permitted to:

  • comply with law, regulation, subpoena, court order, warrant, licensing obligation, or governmental request;
  • cooperate with a regulatory, law-enforcement, or public-safety inquiry;
  • investigate or prevent fraud, unlawful activity, security incidents, or threats to safety;
  • protect and enforce legal rights; or
  • establish, exercise, or defend a legal claim.

Corporate transactions

We may disclose or transfer information in connection with an actual or proposed merger, acquisition, financing, sale of assets, reorganization, bankruptcy, receivership, or other corporate transaction. The recipient will be subject to applicable legal restrictions concerning the information.

At your direction or with consent

We may disclose information to another party when you direct us to do so or provide consent.

5. Payments

Payments may be processed by third-party payment processors. Those processors may collect payment-card and financial information directly under their own terms and privacy policies.

We encourage you to review the processor’s privacy notice before submitting payment information. We do not authorize a payment processor to use payment-card information for its own unrelated marketing purposes.

6. Cookies and Similar Technologies

We and our service providers may use cookies, pixels, tags, local storage, scripts, and similar technologies.

These technologies may be used for:

  • Strictly necessary purposes: Operating the website, processing forms, maintaining security, balancing traffic, and remembering privacy choices.
  • Functional purposes: Remembering preferences and improving website functionality.
  • Analytics purposes: Understanding traffic, page use, errors, and performance.
  • Advertising purposes: Measuring campaigns, attributing inquiries, limiting repeated advertisements, or delivering advertisements based on activity over time and across different websites or services.

You can manage cookies through the cookie-preference tool available on the website cookie settings. You may also control cookies through your browser. Blocking certain cookies may affect website functionality.

Where required, nonessential analytics and advertising technologies will not be activated until an appropriate choice has been made.

Do Not Track

Some browsers transmit a “Do Not Track” signal. Because there is not a universally accepted technical or legal standard for responding to legacy Do Not Track signals, the website may not respond to those signals.

We do, however, recognize qualifying opt-out preference signals, including Global Privacy Control, as described below and as required by applicable law.

7. Sale, Sharing, and Targeted Advertising

We do not sell Personal Information in exchange for monetary payment.

California law defines “sale” and “sharing” broadly. Certain disclosures of identifiers, cookie identifiers, device information, or website activity to advertising and analytics providers may be considered a sale or sharing for cross-context behavioral advertising, even when no money is exchanged.

During the preceding 12 months, we may have sold or shared the following categories through these technologies:

  • identifiers and online identifiers;
  • Internet or other electronic-network activity;
  • approximate geolocation derived from an IP address; and
  • limited inferences concerning advertisement or service interests.

The categories of recipients may include advertising networks, advertising platforms, campaign-measurement providers, analytics providers, and related technology providers.

We do not knowingly sell or share Personal Information concerning consumers under 16 years of age.

You may opt out by:

  • selecting “Your Privacy Choices”;
  • changing your choices through the website cookie settings, or
  • enabling a qualifying opt-out preference signal, such as Global Privacy Control, in your browser or browser extension.

An opt-out preference signal generally applies to the browser or device transmitting the signal. You may need to renew your choice if you use another browser or device or clear cookies.

We will not ask you to opt back in to sale or sharing for at least 12 months after an applicable opt-out request, except as permitted by law.

8. Email and Text Communications

Email

You may unsubscribe from promotional emails by selecting the unsubscribe link in the email or contacting us. Even after opting out of marketing, you may continue to receive nonpromotional communications concerning appointments, services, payments, warranties, safety matters, or legal notices.

Text messages

When you provide a mobile telephone number and agree to receive text messages, we may send appointment reminders, scheduling messages, service updates, customer-support messages, and, where separately authorized, promotional messages.

Message frequency may vary. Message and data rates may apply. You may reply STOP to opt out and HELP for assistance.

Consent to receive promotional text messages is not a condition of purchasing services.

Mobile telephone numbers, text-message opt-in records, and consent information will not be sold or disclosed to third parties or affiliates for their own marketing or promotional purposes. This restriction does not prevent disclosure to vendors that provide messaging services on our behalf or disclosure required by law.

9. Telephone Calls

We may use telephone and call-attribution providers to route calls, measure advertising effectiveness, maintain records, and improve customer service.

Where permitted by law and after appropriate notice or consent, calls may be monitored or recorded for quality assurance, training, documentation, security, or dispute-resolution purposes. You should not continue a recorded call if you do not consent to recording; you may request another available communication method.

10. Data Retention

We retain Personal Information only for as long as reasonably necessary and proportionate to the purposes described in this Privacy Policy.

When determining a retention period, we consider:

  • the nature and sensitivity of the information;
  • the purpose for which it was collected;
  • the duration of the customer or business relationship;
  • warranty, inspection, treatment, repair, and service requirements;
  • licensing, pesticide, construction, environmental, accounting, tax, insurance, and recordkeeping obligations;
  • fraud-prevention and security needs;
  • applicable limitation periods;
  • actual or reasonably anticipated claims or disputes; and
  • legal holds, subpoenas, and governmental requirements.

At the end of the applicable retention period, we will delete, destroy, deidentify, or aggregate information where reasonably practicable, unless continued retention is required or permitted by law.

Deidentified information will be maintained in deidentified form, and we will not attempt to reidentify it except as permitted by law.

11. California Privacy Rights

This section applies to California residents to the extent the California Consumer Privacy Act, as amended, applies to The Termite Guy and the relevant Personal Information.

Depending on applicable law and exceptions, California residents may have the following rights.

Right to know and access

You may request that we disclose:

  • the categories of Personal Information we collected about you;
  • the categories of sources from which we collected it;
  • our business or commercial purposes for collecting, selling, or sharing it;
  • the categories of third parties to whom we disclosed, sold, or shared it;
  • the categories of Personal Information sold, shared, or disclosed for a business purpose; and
  • specific pieces of Personal Information we collected about you.

Right to deletion

You may request deletion of Personal Information we collected from you, subject to legal exceptions. For example, we may retain information needed to complete a transaction, provide a requested service, administer a warranty, maintain security, comply with law, or establish or defend legal claims.

Right to correction

You may request correction of inaccurate Personal Information maintained about you.

Right to data portability

Where applicable, you may request that responsive information be provided in a portable and, to the extent technically feasible, readily usable format.

Right to opt out of sale or sharing

You may direct us not to sell or share your Personal Information. See Section 7.

Right to limit use and disclosure of Sensitive Personal Information

Where we use or disclose Sensitive Personal Information for purposes that trigger the right to limit, you may direct us to restrict that use or disclosure.

We currently intend to use Sensitive Personal Information only for purposes for which California law does not require a right-to-limit mechanism, such as providing requested services, processing transactions, maintaining security, and complying with law.

Rights concerning automated decisionmaking technology

We do not currently use automated decisionmaking technology to make significant decisions concerning consumers as those terms are defined by applicable California law.

If we begin using such technology in a manner that creates additional notice, access, or opt-out rights, we will provide the legally required pre-use notice and request mechanism.

Right to nondiscrimination

We will not unlawfully discriminate against you because you exercised a privacy right. We will not deny services, charge a different price, or provide a different level or quality of service solely because you exercised a right, except as permitted by law.

Please describe the right you wish to exercise and provide enough information for us to identify relevant records.

Verification

We will take reasonable steps to verify your identity and authority. Verification may require matching information you provide with information already maintained by us. We may request additional information where necessary, but information collected for verification will be used only for verification, fraud prevention, security, or legal compliance.

We will not require you to create an account solely to submit a request.

For requests involving specific pieces of information or particularly sensitive records, we may apply a higher degree of verification. We will not disclose highly sensitive information, such as full payment-card numbers, security codes, account passwords, or similar credentials.

Response timing

We will confirm receipt of a request within the period required by law and generally respond to a verifiable request within 45 calendar days. When reasonably necessary and permitted by law, we may extend the response period by an additional 45 days and will explain the reason for the extension.

Authorized agents

An authorized agent may submit a request on your behalf. We may require:

  • proof that you gave the agent signed permission;
  • verification of your identity directly with us; and
  • confirmation directly from you that the agent is authorized.

These additional steps may not apply where the agent has a valid power of attorney under applicable law.

Fees and excessive requests

We generally do not charge a fee for processing privacy requests. We may charge a reasonable fee or deny a request where permitted by law, including when a request is manifestly unfounded, excessive, repetitive, or technically unreasonable. We will explain any denial as required by law.

13. Global Privacy Control

We process qualifying opt-out preference signals, including Global Privacy Control, as requests to opt out of the sale or sharing of Personal Information associated with the browser or device transmitting the signal.

Where we can reasonably associate the signal with a known consumer profile or account, we will apply it as required by law. We will not require you to provide additional information unless it is reasonably necessary to apply the request beyond the browser or device.

14. Financial Incentives

We do not currently offer a financial incentive or price or service difference in exchange for the collection, retention, sale, or sharing of Personal Information.

If we introduce such a program, we will provide a separate Notice of Financial Incentive and obtain any consent required by law before enrollment.

15. California “Shine the Light” Disclosure

California Civil Code section 1798.83 permits certain California residents to request information concerning particular disclosures of Personal Information to third parties for those third parties’ own direct-marketing purposes.

We do not disclose Personal Information to third parties for their own direct-marketing purposes in a manner that requires reporting under that law without providing an applicable choice.

You may submit questions concerning this section using the contact information in Section 24.

16. Children’s Privacy

Our website and services are directed to adults and are not directed to children under 13 years of age. We do not knowingly collect Personal Information online from children under 13.

If we learn that we collected Personal Information online from a child under 13 without legally sufficient parental authorization, we will take reasonable steps to delete it.

We do not knowingly sell or share the Personal Information of consumers under 16 years of age.

17. Information Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect Personal Information, taking into account the nature of the information and the circumstances of processing.

These safeguards may include, as appropriate:

  • access restrictions and authentication controls;
  • encryption in transit and, where appropriate, at rest;
  • secure configuration and software maintenance;
  • employee confidentiality and security requirements;
  • vendor review and contractual safeguards;
  • data minimization and retention controls;
  • monitoring, backup, and incident-response procedures; and
  • secure destruction or deletion processes.

No method of transmission, storage, or security is completely secure. We cannot guarantee that unauthorized access, loss, misuse, or alteration will never occur.

You should not send highly sensitive information through ordinary email, text message, or an unsecured web form.

18. Data Incidents

If we identify a data-security incident involving Personal Information, we will investigate, contain, and remediate the incident as reasonably appropriate and provide notifications where required by applicable law.
